Legal Modes of Operating

 

LEGAL MODES OF OPERATING

 

Legal Mode 0 - Trust Mode

 

The old saying, “Trust must be earned” is a false and incorrect statement. Trust has to be given in order for it to be tested and it is constantly being tested. When two parties enter into an agreement, verbal or written, a Good Faith condition is created thus Trust is given by both parties towards both parties respectfully. This is what the Company refers to as Trust Mode. All communications, transactions and company business under normal conditions operate in the Trust Mode. Standard Policies and Procedures of documentation of normal subject events, Accounting, Estimates, Invoices, photographs, etc., are performed guided by written Policies and Procedures.

 

Legal Modes

 

Legal Mode is a condition where strict Policies and Procedures are enforced to serve as a Legal shield of Protection when the Good Faith condition between the Company and the Client no longer exist due to provable evidence that the Client acted in the manner that failed the test. There are three levels of Legal Mode;

  1. Level 0, Good Faith condition is created thus Trust is given by both parties towards both parties respectfully.
  2. Level 1, Proof of the act of providing untruthfulness and/or purposely giving false information to the company, agent, etc., by the Client.
  3. Level 2, Proof that the client is contemplating legal action using key words verbally or in writing, Fines, Sued, Legal Action, Law Suit, Lawyer, Attorney, threats of legal action, etc. Proof of the act of providing untruthfulness and/or purposely giving false information to the company, agent, etc., by the Client. Verbal hostile and/or abusive communication in person, via telephone and/or in writing toward an employee and/or company representative.
  4. Level 3, Proof the Client has filed for legal action.

 

Legal Mode Level 0

Legal Mode Level 1

The Trigger> Trust is in question based on the Client’s behavior. Increased documentation of all aspects of the Job/Project includes photographing before and after of all work being performed. Written notations in the Job/Project Journal (revised/added 12/06/2020) on verbal conversations, written confirmation to the Client of up coming scheduled work.

 

Legal Mode Level 2

The Trigger> Client has retained legal representation. Only written communication between the Company and the Client and/or Client’s legal representative. A directive issued to all employees not to communicate with the Client in any form, on any subject concerning the Job/Project, the Company and/or any information about the Company. Detailed entries are to be written in the journal of all activities on the Job/Project Site. Photographs will be taken upon arrival, all work before and after and departure photographs. A written and photography inventory of used and unused materials, which are left in the care of the Client, shall be recorded. Audio/video surveillance equipment activated and in use minutes prior to entering, departing and the entire time while on the Client’s Property.

 

Legal Mode Level 3

The Trigger> Client has file a legal suit against the company. All aspects of Legal Mode Level 2, in addition, no communication about the Job/Project between the Client and Legal Representative. All correspondence shall be routed though the Company’s Legal Representative.
